Terms of Service

Welcome to Transportbidder. By downloading, installing, or using our mobile applications (User App and Driver/Partner App) or website, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.

1. Definitions

• "Platform" refers to the Transportbidder mobile apps and website.
• "User" or "Passenger" refers to anyone who uses the User App to request rides or book tours.
• "Driver" or "Partner" refers to anyone who uses the Driver App to offer transport services.
• "Ride" refers to any transport service facilitated through the Platform.
• "Bid" refers to a price offer made by a Driver or User for a Ride.

2. Eligibility

• You must be at least 18 years old to use our services.
• Drivers must hold a valid driver's license and meet all local regulatory requirements.
• Drivers must complete the verification process, including document uploads and background checks, before accepting rides.

3. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must notify us immediately of any unauthorized use of your account.
• One account per person. Multiple accounts may result in suspension.

4. Bidding & Pricing

• Users may set a desired price for a ride. Drivers may accept, reject, or counter-bid.
• Transportbidder does not set or guarantee fares. Prices are determined by the bidding process between Users and Drivers.
• A fair price estimate is provided as a guideline but is not binding.
• Once a bid is accepted by both parties, it becomes the agreed fare for the ride.

5. Wallet & Payments

• Drivers must maintain a positive wallet balance to accept rides. A platform fee is deducted per ride.
• Wallet credits are non-refundable except as required by applicable law.
• Users pay Drivers directly for rides. The Platform facilitates the connection but is not a party to the payment transaction between User and Driver.
• Transportbidder reserves the right to adjust platform fees with reasonable notice.

6. Rides & Safety

• Drivers are independent contractors, not employees of Transportbidder.
• Drivers are responsible for maintaining their vehicles in safe, roadworthy condition.
• Both Users and Drivers must comply with all applicable traffic and safety laws.
• Real-time GPS tracking is active during rides for safety purposes.
• Transportbidder is not liable for any incidents that occur during rides.

7. Tours & Attractions

• Tours are offered by third-party agencies through our Platform.
• Transportbidder facilitates bookings but does not operate tours directly.
• Tour cancellation and refund policies are set by individual agencies.

8. Prohibited Conduct

You agree not to:

• Use the Platform for any illegal purpose.
• Harass, threaten, or discriminate against other users.
• Create fake accounts or provide false information.
• Manipulate the bidding system or engage in price fixing.
• Attempt to circumvent Platform fees by arranging off-platform payments.
• Reverse-engineer, decompile, or tamper with the app.

9. Account Suspension & Termination

• We reserve the right to suspend or terminate accounts that violate these Terms.
• Drivers who fail verification or receive repeated complaints may be deactivated.
• You may delete your account at any time by contacting us.

10. Intellectual Property

All content, design, logos, and software of the Transportbidder Platform are owned by us and protected by intellectual property laws. You may not copy, modify, or distribute any part of our Platform without written permission.

11. Limitation of Liability

To the maximum extent permitted by law:

• Transportbidder is provided "as is" without warranties of any kind.
• We are not liable for indirect, incidental, or consequential damages.
• Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

12. Dispute Resolution

• Any disputes shall be resolved through good-faith negotiation first.
• If negotiation fails, disputes will be submitted to binding arbitration in Lima, Peru.
• These Terms are governed by the laws of Peru.

13. Changes to Terms

We may update these Terms from time to time. Continued use of the Platform after changes constitutes acceptance. We will notify you of significant changes through the app or email.
